The permit violations are true, but it is being being worked.


To date, none of the 34,878 cubic yards of dirt have been removed. So I don't know what you mean by "it is being worked", because nothing has been done to correct the violation.


For the record, the dirt is stockpiled on previously cleared land that has been in use by many tenants, including the US Military since WWII and earlier. There are NO archaelogical sites or ancient burial grounds located within the Phase 1 section...which is where the dirt is being stockpiled.


For the record, the stockpile is illegal. And you are missing the point of the warning issued about archaeological sites and endangered species. Regardless of where any construction is planned on the lot, the permitting process will have to include going through several more relevant agencies. A process that will take years. Not 2 weeks as your inept leader is claiming.

A number of accusations have flown in recent weeks between the Souzas and the Graces.

One of the issues is the dumping by Grace and other trucking companies of more than 1,800 truckloads of dirt on the Kalaeloa property from an Ewa Villages public housing construction site.

Both the Souzas and Grace agree that dirt is needed for the racetrack. But the Souzas feel Grace and the other truckers are taking advantage of the situation and have put too much dirt on the property.

Grace said he and the truckers did nothing wrong.

Considering the illegal dumping violation, I'd say the Souza's point was valid and Grace was wrong (again).

Dave, Micah didn't mess up. When we initially started, there was confusion with the permit office whether we needed to get a permit or not. When we told DHHL what was going on down there, they had initiated a letter to DPP, informing them of their support with the project and requested a 20 day response from them whether a permit was required or not. When the 20 days went by and no response was received, we were given the green light to proceed. Which we did.

Then the anonymous complaints came in from a Makakilo resident and mysterious beach goers complaining that they see trucks hauling dirt onto the property. When that happened, DHHL had talks with DPP and they both agreed that we would go ahead and go through the permit process.

The City inspector that came out to the property was just doing his job and that was to follow up on the complaint about the dirt and dust on the property. He saw the dirt and also saw that there was no dust anywhere. Even though it was a windy day. He told me that he would have to follow procedures and issue a Notice of Violation. I had no problem with that. I explained to him the issues that lead up to this point and also emailed him the letter from DHHL to DPP. I have had to pay NO fines and as long as I am in compliance, will not have to pay any fines.

I have open communications with DHHL as well as the City. Les likes to take things and draw his own conclusions. Just like he did when he kept insisting that the Souza's had the lease for P24, even though it clearly stated otherwise. Like Les stated that the dirt was contaminated, when the clearance also stated otherwise. Like he would ramble on saying that DHHL doesn't support the project, which they do.

The NOV is just a procedure, due to the fact that the Souza's and Les are constantly trying to get the city to initiate discipline regarding the dirt.

It was explained to me that if it wasn't for the complaints we would not have had to halt the construction. In respect to the City and with the support of DHHL, we're going to be in compliance.

Yes you WILL have to pay the fines as stated in the Notice of Violation. And you are NOT in compliance which is why the violation was issued.

The permitting office was NEVER confused about permits. It was because you were lying to DHHL about it!
